REPRESENTATIVE MATTERS


Managed development of 280,000 sf shopping center in Monmouth County, NJ, including negotiation of favorable infrastructure cost-sharing agreement with adjacent shopping center.

 

Managed development 350,000 sf shopping center in the Pinelands in Atlantic County, NJ and obtained NJDEP approval for private water well to service site during statewide moratorium on
new public water connections.  

 

Negotiated Brownfields Remediation Reimbursement Agreement with State of New Jersey, whereby State
agreed to reimburse purchaser of former gas station for 75% of remediation costs for onsite contamination.

 

Obtained NJDEP and New Jersey State House Commission approvals for “diversion” of state-owned Green Acres land to municipality, so that client could build new public road needed for shopping center development. 

 

Supervised lawsuit against major petroleum company and negotiated favorable settlement for client whose property was leased to a gas station and contaminated by leaking underground storage tanks. 

 

Handled acquisitions of numerous properties for 190-acre assemblage in Gloucester County, NJ.  Managed zoning litigation with town that banned big box stores, and negotiated settlement with town that allowed mixed residential/towncenter/big box development to go forward.  Obtained and maintained Farmland Tax
Assessment for property during pendency of litigation.

 

Represented purchaser of 800,000 sf manufacturing facility in Middlesex County, NJ which involved contaminated property and complex cross-easements with neighboring properties.

 

Represented health care system in acquisition of 400,000 sf office building facility in Livingston, NJ, which was converted to ambulatory care center.  Negotiated reciprocal easements and common area maintenance cost-sharing with third party.  Also handled leases to doctors and other health care providers. 

 

Handled real estate aspects of refinance of $500,000,000 NJEDA bond financing covering all corporate assets and operations of large health care system. 

 

Represented New York City hard money lender making mortgage loans to urban multi-family properties in New Jersey. 

 

Represented New Jersey banks making mortgage loans to businesses and to multi-family properties.

 

Handled purchase, sale and financing of multi-family properties, including urban renewal projects, in New
Jersey, Pennsylvania and Connecticut.

 

Handled purchase of 120,000 sf condominium warehouse space in Morris County, NJ.

 

Represented purchaser of commercial mortgage on mixed-use inner city building in foreclosure.  Completed foreclosure, acquired title to property at sheriff’s sale and resolved dispute with court-appointed receiver.

 

Represented landlord making loans to tenant for leasehold improvements and restaurant equipment.  Subsequently, handled summary dispossess, money judgment suit on commercial loan, and foreclosures of residential mortgages given as collateral security for personal guarantees.

 

Negotiated and prepared 90,000 sf lease for office/warehouse/light manufacturing use, on behalf of landlord.

 

Represented national bank in workouts of distressed loans to commercial borrowers.

 

Negotiated and consummated purchase of $750,000 worth of Pinelands Development Credits (PDCs) from various owners in the New Jersey Pinelands.

 

Closed the purchase of land in Passaic County for development of Residence Inn and negotiated release of use restrictions from neighboring William Paterson University.

 

Handled many residential foreclosures for national home mortgage lender.

 

Prepared legal briefs and pleadings in successful litigation re title insurance coverage for loss arising
out of encroachment of building onto utility easement not shown on survey.
